Official Rules

No purchase necessary to enter, PLAY OR WIN. A purchase will not improve your chances of winning. THE FOLLOWING CONTEST IS INTENDED FOR PLAY IN THE UNITED STATES ONLY. DO NOT ENTER THIS CONTEST IF YOU ARE NOT LOCATED IN THE UNITED STATES.

1. DESCRIPTION OF CONTEST: This is a contest of skill, not a game of chance. Via online monthly entry only, entrants will have the opportunity to win one (10) of ten (10) prize packs awarded each month consisting of $50 of Carolina Pad products, and have their entry and name posted on the Carolina Pad Web site at www.carolinapad.com. Entries will be accepted monthly between August 1, 2008 and July 31, 2009. Non-winning monthly entries will roll over to each subsequent entry period. Judges will select ten (10) Prize winners, based on the criteria stated in Section 6.

By submitting your entry into the contest you have agreed ("opted-in") to receive no more than 2 promotional e-mails in a 30 day period, the subject matter will include contests notifications, contests winners, Carolina Pad promotions and specials. This is in addition to the normal business communications you may receive as an Carolina Pad customer. Carolina Pad does not spam or send any unsolicited e-mail. Carolina Pad also does not sell, rent, or distribute its contest or customer lists to anyone. Please read the full Carolina Pad Privacy Policy.

By mail. Carolina Pad does not accept mail entries. You must use the Carolina Pad Web site to submit your contest entry.

Signing up as a registered Carolina Pad user. If you signed up as a registered user of www.carolinapad.com you are not automatically entered into the Carolina Pad Monthly Contest. You must register for each contest. Contest submissions will not be carried over to the next contest. Carolina Pad is not responsible for errors, omissions, interruptions, deletions, defects in part or whole, delays in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for any technical or non-technical network, telephonic, electronic, computer, hardware, or software malfunctions of any kind, or inaccurate or partial transmission of or failure to receive entry information by Carolina Pad on account of technical problems or traffic congestion on the Internet, at any Web site, or any combination thereof. Carolina Pad is not responsible for any injury or damage to entrants or any other person's computer related to or resulting from playing or downloading any materials in the Carolina Pad Monthly Contest. All entries become Carolina Pad's property and will not be returned. Carolina Pad reserves the right to cancel temporarily or permanently the electronic method of Carolina Pad Monthly Contest entries if it becomes technically corrupted.

2. ELIGIBILITY: The Carolina Pad “Monthly Contest (the “Contest”) is open only to legal residents of the 48 contiguous United States (including the District of Columbia), who are 18 years of age or older at the time of entry. Employees of Carolina Pad, LLC (“Carolina Pad” or “Sponsor”), as well as the immediate family members (spouse, parents, siblings, and children) and household members of each such employee, are not eligible. Void in Alaska, Hawaii and where prohibited or restricted by law. Contest is subject to all applicable federal, state, and local laws and regulations.

3. HOW TO ENTER: To enter, visit www.carolinapad.com and complete the official online entry form, including your name, address, day and evening telephone numbers, and e-mail address. You will be required to (1) verify you are 18 years of age or older at time of entry; and (4) accept the Official Rules between 12:01 am Central Time (“CT”) on August 1, 2008 and 11:59 p.m. CT on July 31, 2009 (the “Promotional Period”). Upon completion of the official entry process, click “upload.” All entries must be received by 11:59 p.m. CT on the entry deadline as specified in Section 4 to be eligible. Photographs must be in .jpeg, .tiff, .raw or .png format and no larger than 4 MB. If you have special needs within the meaning of the Americans with Disabilities Act, and require assistance in order to participate in the Contest, call (704) 588-3190 and ask for the Contest Administrator. Carolina Pad is not responsible for lost, late, damaged or misdirected entries. Limit one (1) entry per person/e-mail address per entry period. Any individual attempting to submit multiple entries per entry period will be disqualified.

4. MONTHLY ENTRY PERIODS/ENTRY DEADLINES AND NOTIFICATION SCHEDULE: Entries must be received online by 11:59 p.m. CT on the entry deadline to be eligible for that entry period. Each Prize winner will be notified by Carolina Pad.

5. CRITERIA FOR ENTRIES: Entrants must submit the items specified in Section 3 of the rules to be considered. Any written and/or photographic submission submitted as part of entry (“Entry”) must be original and may not have been previously published or submitted in any other contest. Submissions must be written in English. Written submissions that exceed specified word limits will be disqualified. Entries cannot defame or invade the rights or privacy of any person, living or deceased, or otherwise infringe upon any third party’s personal or proprietary rights. Photo submissions that include any trademarked, copyrighted, or proprietary brand name, logos, images, or objects, federal, state and/or municipal buildings, monuments, flags or landmarks, any private property, landmarks, or monuments that would require approval of a third party may be disqualified if the sponsor is unable to obtain the proper release and/or releases determined at the sole discretion of the sponsor. Entries must be consistent with the Carolina Pad Brand reputation in the marketplace and must be suitable for audiences of all ages. Entries which, in the judges’ sole discretion, contain any type of vulgarity or objectionable content will be disqualified.

6. JUDGING CRITERIA, SELECTION AND NOTIFICATION: Judges will select ten (10) Prize winners from among all eligible entries received each entry period during the Promotion Period, provided a sufficient number of eligible entries are received. Judging will be completed for each entry period on or about five (5) days after the entry deadline. The judging panel will consist of qualified representatives from Carolina Pad.

The entries with the highest point totals will be selected as the potential Prize winners each month subject to confirmation of eligibility, Sponsor approval, and provided that any entry may be eliminated, regardless of point total, in the judges’ or Carolina Pad sole discretion (i) if it is not consistent with Carolina Pad reputation in the marketplace, including its reputation for quality and integrity, (ii) if it does not reflect the goals of the promotion, (iii) if the entry is so deficient in grammar, spelling, sentence structure, or content as to be unclear or inappropriate. In the event of ties in point totals among entrants, judges will revisit the tied entries and choose as potential Prize winner the entry that best reflects all criteria as a whole. Non-winning entries that roll over into subsequent periods will carry their original point total, which will be compared against totals for entries received later, and a winner selected accordingly.

7. PRIZE AND APPROXIMATE RETAIL VALUES: Each prize will consist of any one collection of Carolina Pad products as selected at the discretion of the Sponsor (Approximate Retail Value of Prize $50 each). Winner will not receive the difference between actual and approximate retail value. All federal, state, and local taxes and fees are the sole responsibility of the winner. Sponsor will comply with all income tax reporting obligations. Prize consists only of items specifically listed as part of the prize. Honorable Mention: At the Sponsor’s discretion, a minimum of ten (10) entries will be selected per month and posted on Carolina Pad Web site with Honorable Mentions. No prize will be awarded to the Honorable Mention entrants.

8. PRIZE WINNERS: The Prize is not transferable; no prize substitutions or cash alternatives are allowed except as may be determined by Sponsor in its sole discretion. Except where prohibited, acceptance of the Prize constitutes the winner’s consent that their names, likenesses, and/or biographical data may be used for advertising and promotional purposes without limitation and without additional notice, compensation, or consent.

9. NOTIFICATION: Prize winners will be notified by e-mail sent to the e-mail address submitted on the original contest entry form, and Carolina Pad is under no obligation to notify winners by any means other than e-mail. If a winner's Carolina Pad profile is no longer active, notification will be sent to the last known e-mail address. Carolina Pad is not responsible for notifications that are misdirected or not received because of e-mail addresses that are no longer correct. If a potential winner cannot be reached after a reasonable effort has been made during one (1) business day from the first notification attempt, such person may be disqualified, with an alternate winner selected. Any prize notification or prize returned as undeliverable will result in the awarding of that prize to an alternate winner.

10. REDEMPTION: Carolina Pad will deliver the prizes as follows: Each prize will be shipped to the appropriate winner's home address. Prizes are non-transferable and no substitutions or cash equivalents are allowed except by Carolina Pad, who also reserves the right to award a prize of equal or greater value if the advertised prize is unavailable.

11. SHIPPING OF PRIZES: Carolina Pad will utilize the most economical method for shipping contest prizes. Although Carolina Pad ships with well-known carriers and does not anticipate delivery problems, unforeseen circumstances can happen from time to time that creates situations resulting in lost shipments or damaged merchandise. If your prize is not received within the window specified by the final prize e-mail, contact Carolina Pad and we will initiate the appropriate paperwork with the shipper. The shipper will require a period of time to determine the status of the package, which could be up to seventy-two (72) hours. During this time you will need to wait for the final determination as to how Carolina Pad will resolve the lost or damaged merchandise. If the product is no longer available, Carolina Pad reserves the right to replace the item with a like product of similar or greater value.

12. ASSIGNMENT OF RIGHTS: By entering, contestant explicitly acknowledges and agrees that Carolina Pad reserves the right to publish in any media, including print, radio, and online, any or all content of the essay and photograph submitted with or without first and last name credit to the entrant; and entries that attempt to restrict this right will not be considered. All entries become the property of Carolina Pad and Carolina Pad shall hold all copyright, ownership, title, and right thereto. An entrant’s submission of an entry constitutes permission for Carolina Pad to use the entrant’s name, story, photograph and other material provided in the entry for any purpose, including for promotional purposes in any media without compensation. Prize winners shall execute at Carolina Pad request such assignments and other documents as may be necessary to confirm or enact this assignment.

13. BY ENTERING THE CONTEST: Participants release and hold harmless Sponsor, affiliates, directors, officers, employees, and agents from any and all liability for any injuries, loss, or damage of any kind arising from or in connection with this Contest or any prize won, including any injuries, loss or damage of any kind arising from or in connection with participation in the Contest. Sponsor is not responsible for any typographical or other error in the printing of this offer, administration of the Contest or in the announcement of prizes. In the event Sponsor is prevented from continuing with this Contest, or the integrity and/or feasibility of the Contest is undermined by any event including but not limited to fire, flood, epidemic, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, war (declared or undeclared), terrorist threat or activity, or any federal, state or local government law, order or regulation, order of any court or jurisdiction, or other cause not reasonably within Sponsor’s control (each a “Force Majeure” event or occurrence), Sponsor shall have the right, in its sole discretion, to abbreviate, modify, suspend, cancel, or terminate the Contest without further obligation and, if so, Sponsor reserves the right, but not the obligation, to award the prize from among all valid and eligible entries received up to the time of such Force Majeure event. All entries are the property of Sponsor and are not returnable.

14. ONLINE REGISTRATION: This Contest is intended for viewing in the United States only and shall be construed and evaluated according to U.S. law. Do not enter this Contest if you are not located in the 48 contiguous United States or if you are not a legal U.S. resident. If for any reason, the computerized entry portion of the program is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other cause beyond the control of Sponsor which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Contest, Sponsor reserves the right at its sole discretion to disqualify any individual who tampers with the entry process and to cancel, terminate, modify, or suspend the Contest. Each entry must be manually key-stroked and manually entered by the individual participant. Repetitive automated electronic submission of entries is specifically prohibited, and any such entries will be disqualified. Entries will be deemed made by the authorized account holder of the e-mail address submitted at the time of entry. In the event of a dispute, the potential winner may be required to provide proof that he/she is the authorized account holder of the identified e-mail account, and Sponsor’s decision will be final. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries, including any error that may result in an erroneous appearance of qualification for a prize. Sponsor is not responsible for any problem or technical malfunction of any computer equipment or software that results in loss of entry. WARNING: ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE ANY COMPUTERIZED SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGE FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
